The instant criminal revision petition under
Section 397 r/w Section 401 Cr.P.C. is preferred by the petitioner against the order dated 04.01.2007 passed by the Additional Chief Judicial Magistrate (Communal
Riots), Jaipur City, Jaipur in Criminal Case No. 341/2003, whereby the Court below has framed charges against the accused-petitioner for the offences under
Sections 467, 468, 471, 420, 120-B and 408 IPC.
Learned counsel for the petitioner submits that the FIR has been lodged on 15.01.93, whereas the charge has already been handed over by the petitioner on 06.01.93 and this document is placed as Annexure-5 along with the revision petition.
Having considered the rival submissions of the respective parties and after going through the impugned
(2) order, in the interest of justice, I deem it proper to quash and set-aside the impugned order dated 04.01.2007 passed by the trial Court and remit the matter back to the trial Court for fresh adjudication after appreciation of the documents so filed by the petitioner and then pass fresh order regarding framing of charge.
With the aforesaid observations, the revision petition stands disposed of.
