Though the appellant has moved an entirely misconceived application seeking exemption from depositing the amount as required by Section 173 of the Motor Vehicles

Act on the ground of his alleged poverty, learned counsel for the appellant Mr.L.D.Khatri on instructions submits that the matter has been settled between the parties and the appellant does not want to proceed with this appeal and, therefore, he does not press the same.

Even otherwise, this appeal remains incompetent for the appellant having not complied with the requirements of

Section 173 of the Act. However, in view of the submissions made, the appeal is dismissed as not pressed.
