Learned counsel Mr. Ramesh Purohit submits that he has filed Vakalatanama on behalf of the appellants in the

Registry on 31.01.2007 and also submits that he has already put in appearance on behalf of the appellants in the cognate matter, being CMA No.588/2006 filed by the insurer of the vehicle involved in the accident.

In view of the submissions made, the defect is taken as cured. Learned counsel, however, submits that in the overall facts and circumstances of the case, the appellants shall stand advised not to proceed with this appeal and, therefore, does not want to press the same.

The appeal is, therefore, dismissed as not pressed.
