MADHU SUDAN SHARMA v STATE CONSUMER DISPUTE REDRESS - CW Case No. 5482 of 2002 [2007] RD-RJ 12 (2 January 2007)
S.B. Civil Writ Petition No.5482/02 02.01.2007
Hon'ble Mr. Justice Mohammad Rafiq
Mr. V.K. Jain for petitioner.
Mr. Basant, Dy. GA for State.
No one is present for the respondent even when the case is called in the second round.
Originally when this writ petition was filed the petitioner had prayed for a direction that State
Consumer Disputes Redressal Commission be restrained for hearing his complaint pending before that Commission with only two members when its President has marked the case as exception. Although the notice to show cause was issued to the respondent by order dated 1.10.2002 but no interim order was passed and it is not known whether the case of the petitioner is still pending or has been decided. The learned Dy. Government Advocate however informed the Court that the term of the then President of the Commission having come to an end, new President was appointed more than a year ago and, therefore, the grievance raised in the petition does not survive. In the light of the statement made by the leaned Dy.
Government Advocate, the petition does not survive and is accordingly dismissed as having become infructuous.
