This is second bail application.
Heard learned counsel for the petitioner and the Public
Prosecutor for the State. Perused the challan papers as also the statements of the prosecution witnesses.
PW.3 Mahesh Kumar is the witness in whose presence, the present petitioner instigated and conspired with other co-accused viz. Sanjay alias Baba, Vijay alias Bunty, Ravi Kumar, Rakesh alais Rodia for committing dacoity and in furtherance of the conspiracy hatched by the present petitioner with these co- accused, they looted a huge amount by committing murder of one Shiv Narayan Agarwal . In the circumstances, therefore, in my view, it is not at all a fit case for grant of bail.
The bail application is, therefore, dismissed.
