YADRAM v STATE AND ORS - CW Case No. 2152 of 2007  RD-RJ 1605 (2 April 2007)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
AT JAIPUR BENCH
S.B. CIVIL WRIT PETITION NO.2152/07
Yad Ram Versus State & Ors.
DATE OF ORDER :: 02/04/2007
HON'BLE MR. JUSTICE AJAY RASTOGI
Mr. N.K. Singhal, for petitioner
Instant petition has been filed by petitioner against the order Ann.5 dated 28th February, 2007 whereby he has been removed from service.
Counsel has raised various pleas assailing the order impugned.
In my considered opinion, the order impugned is appealable under Rule 23 of CCA Rules, 1958.
In view of alternative remedy available to the petitioner, I am not inclined to exercise jurisdiction of this court under Article 226 of the Constitution of India. Accordingly, the writ petition stands dismissed. Petitioner is always at liberty to file appeal, if so advised, under the Rules, 1958. [AJAY RASTOGI],J.
