STATE & ANR v GIRDHARI LAL & ORS - CSA Case No. 218 of 2006 RD-RJ 1666 (4 April 2007)
S.B.Civil Second Appeal No.218/2006.
State of Rajasthan and another. vs.
Girdhari Lal and others.
Date : 4.4.2007
HON'BLE MR. PRAKASH TATIA, J.
Mr. HR Soni, AGA, for the appellants.
Heard learned counsel for the appellants.
The appellants have filed the present second appeal against concurrent finding of fact recorded by the two courts below about way in dispute.
Learned counsel for the appellants tried to submit that the two courts below misread the evidence and misconstrued the documents also but this Court after going through the documents is of the view that the two courts below considered every piece of evidence very carefully and thereafter recorded that the way has already been recorded in the jamabandi of samwat year 2014 to 2017 and by oral evidence, the plaintiffs proved the way in question.
In view of the above, I do not find any substantial question of law involved in this appeal.
Consequently, this second appeal, having no merit, is hereby dismissed.
(PRAKASH TATIA), J.
