One of the contentions of counsel is that petitioner was served with the charge sheet under
Rule 16 of CCA Rules, 1958 vide order Ann.3 dated 28th June, 2000 and detailed reply has been submitted by him and no action was taken thereafter. But the respondents have now converted the inquiry which was initiated under
Rule 16 to Rule 17 of the rules vide their notice dated 15th March, 2007 [Ann.12] and he was called upon to submit his explanation within 15 days - in compliance whereof, reply has also been submitted by petitioner.
His basic contention is that the inquiry remained pending atleast by now for almost 6 years and that certainly deprived of his future right of consideration for promotion.
Without going into merits at this stage any further, I consider it proper to direct the respondents to consider the explanation furnished
CW 2276/07 by petitioner pursuant to notice dated 15th March, 2007 and pass order in compliance thereof within two months in accordance with law.
