SHRI DHAN SINGH v STATE OF RAJ - CW Case No. 7059 of 2003 RD-RJ 1734 (6 April 2007)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
BENCH AT JAIPUR
S.B. Civil Writ Petition No.7059/03
Dhan Singh Vs. State of Raj. & Ors. 06.04.2007
Hon'ble Mr. Justice Mohammad Rafiq
Shri B.L. Awasthi, Addl. Government Advocate for State.
This petition was registered on the basis of a letter sent by the petitioner alleging death of his son
Hemant Kumar under mysterious circumstances at his in- laws place. Notices were issued to the respondents, who have filed reply to the writ petition supported by affidavit of Dy. S.P. (Traffic) City Ajmer. The learned
Additional Government Advocate has also produced the copy of the case diary and the report prepared by the police under Section 174 of the Code of Criminal
Procedure. On perusal of the report I find that the police prima facie found it to be a case of suicidal death of the petitioner's son due to asphyxia by hanging. The postmortem report available on record also indicates that there was no external injury on any part of the body. The police on the basis of the facts concluded that it was a case of suicidal death.
In the facts of the case, therefore, I do not consider it appropriate to continue this petition any further.
The writ petition is accordingly dismissed.
