Mr.Ashok Upadhyay, PP for the State.
The learned counsel for the petitioners does not want to press this misc. petition on merit. However, he seeks liberty to raise all the objections which have been raised in this misc. petition before the the learned trial Court at the time of framing of charge. The learned counsel for the petitioners also states that the learned Magistrate has issued warrant of arrest against the petitioners and hence, the petitioners may be given liberty to appear before the learned Magistrate and the learned Magistrate may be directed to decide the bail application on the same day.
Accordingly, the present misc.petition is dismissed as not pressed. The petitioners may surrender before the learned
Additional Chief Judicial Magistrate No.4, Bikaner who shall decide the bail application in accordance with the law on the same day.
The petitioners are also at liberty to raise all the objection which have been raised in this misc.petition before the learned trial court at the time of framing of charge.
