Shri Vijay Pathak, the learned counsel for the petitioner submits that the licence for running the fair price shop for Ward / Panchayat Bhukrawali in

Tehsil Hindaun of District Karauli was given to the petitioner Gram Seva

Sahakari Samiti, Bhukrawali. The petitioner society by passing a resolution on 20.10.2000 decided to shift the place for distribution of essential

CW 2352/07 commodities from Bhukrawali to Sooroth which is at a distance of about one and a half kms. and duly informed the licensing authority about the said shift. The licensing authority however served upon the petitioner a show cause notice on 30.11.2006. Even though the petitioner duly replied to the notice, its licence was arbitrarily suspended by Annexure-7 dated 30.11.2006 and the licensing authority is not passing the final order on the representation submitted by the petitioner.

Having heard the learned counsel for the petitioner I find that the petitioner has the remedy before the departmental authorities and can also request the licensing authority to take a final decision in the matter. I therefore

CW 2352/07 set the petitioner at liberty to make a representation to District Supply

Officer, Karauli giving all those grounds which he has mentioned in the present writ petition who shall consider and decide the same in accordance with the law as expeditiously as possible but in no case later than six weeks from the date of receipt of copy of this order.

With the above observations, the writ petition stands disposed of.
