This criminal revision petition under Section 397 r/w Section 401 Cr.P.C. is preferred against the order dated 10.09.99 passed by the Additional Sessions
Judge No.2, Jaipur District, Jaipur in Criminal
Revision No. 16/99, whereby the Court below while allowing the criminal revision, has set-aside the order dated 24.05.99 passed by the Civil Judge (Jr. Division) & Judicial Magistrate, Bassi in Criminal Case No. 238/99 and quashed the cognizance taken against the accused-non-petitioners for the offence punishable under Sections 447, 504 IPC and Section 3 of the SC/ST
Act and accepted the final report.
I have heard learned counsel for the petitioner, learned Public Prosecutor for the State and have also carefully perused the record available before /2/ me and gone through the order passed by the trial Court as well as by the Additional Sessions Judge No.2,
Jaipur in revision.
The Additional Sessions Judge has considered all the aspects and the material available on record and found that no offence under Sections 447, 504 IPC and Section 3 of the SC/ST Act is made out against the accused-non-petitioners and, therefore, accepted the final report submitted by the police.
I find no illegality in the impugned order dated 10.09.99 and the same requires no interference whatsoever by this Court.
Consequently, the revision petition fails and the same is hereby dismissed.
Record be sent back forthwith.
