RAHUL SHARMA v UNIVERSITY OF RAJASTHAN - CW Case No. 2693 of 2006 RD-RJ 1906 (12 April 2007)
IN THE HIGH COURT OF JUDICATURE FOR
S.B. Civil Writ Petition No.2693/06
Rahul Sharma Vs. University of Raj. &
Hon'ble Mr. Justice Mohammad Rafiq
Shri Mahesh Gupta for petitioner.
Shri Manish Bhandari for respondents.
The writ petition has been filed with the grievance that the petitioner had appeared in B.B.A. Part-I
Examination, 2005. Originally he was declared failed but when he applied for revaluation in which he was declared pass having secured 48% marks in aggregate.
The result was declared on 27.3.06 and the mark sheet was given on 31.3.06. In the meantime, the examination of B.B.A.
Part II approached, but the respondents did not allow him to appear in that examination. He has appeared in the said examination under direction by this Court dated 3.4.2006. Now the examination of
B.B.A. Part III is approaching.
Upon hearing the learned counsel for the petitioner, I find that once on revaluation he was declared pass and eligible to appear in B.B.A. Part II examination, there is no reason for the respondents now to withhold the result of his B.B.A. Part II examination. It is therefore directed that the respondents shall declare the result of the petitioner for B.B.A. Part II examination and if the petitioner is found have passed in that examination, permit him to appear in B.B.A. Part III examination in
CW 2693/06 accordance with the rules.
With the above directions, the writ petition is disposed of.
