M/S MOTILAL NANNULAL v STATE - CW Case No. 6115 of 2006 [2007] RD-RJ 1997 (16 April 2007)

CW6115/06

IN THE HIGH COURT OF JUDICATURE FOR

RAJASTHAN

JAIPUR BENCH

S.B. Civil Writ Petition No.6115/06

M/s Motilal Nannumal vs. State of Raj. &

Ors. 16.04.2007

Hon'ble Mr. Justice Mohammad Rafiq

Shri Prashant Chahar for petitioner.

This writ petition was filed by the petitioner way back on 26.7.2006 with the grievance that the various functionaries of the State, especially their police authorities have not been providing protection to him against some anti social elements in spite of many

First Information Reports lodged by him.

It has been contented that petitioner is engaged in the mining at Village Sehu

Tehsil Deeg, Distt. Bharatpur ever since

CW6115/06 1967 when total area of 309.185 hectares was leased out to him. This lease has been extended from time to time and is now valid upto 2.5.2017. Reference has been made to the various F.I.Rs. filed with the police station Deeg. It is contended that these anti social elements are pressuring the petitioner to illegally extract money and in the event of not fulfilling their demand, threatened him with dire consequences.

It has been therefore prayed that the respondents be directed to take action against these anti social elements / the accused persons named in the FIR and provide protection to the petitioner who is citizen of the country.

Having heard the learned counsel for the petitioner, I find that in spite

CW6115/06 of directly entertaining the writ petition on the questions raised in the petition, it would be appropriate to set the petitioner at liberty to make a representation to both the Collector,

Bharatpur and Superintendent of Police,

Bharatpur within four weeks detailing out all his grievances therein who shall look into them and do the needful in accordance with law.

With these observations, the writ petition is disposed of.

(Mohammad Rafiq),J.
