Petitioner, Automobile Transport Help Co- operative Society Limited has filed this writ petition on 14.3.2002 with the prayer that respondents be directed to delete 35 marks while evaluating the candidature provided under para 3.10 of the guidelines

(Annex.4) while making assessment and selection for awarding retail petrol outlet at Anna Sagar, Ajmer and further that 20 marks awarded for personality etc. mentioned in clause (a) 3.10 of the guidelines, may be ordered to be deleted.

No one was present on behalf of the petitioner on the last date of hearing also.

When the matter was taken on 8.12.2006 and today also nobody has put in appearance on their behalf.

Learned counsel for the respondents submits that petrol pump at Anna Sagar,

Ajmer, has been allotted long back in favour of some other party. The petitioner has however not challenged such allotment nor has he impleaded such allottee as party to this petition. Besides, he submits that the policy of allotment as contained in the office memorandum dated 9th of October, 2000 of the Ministry of Petroleum and Natural

Gas, Government of India has since been superseded by an altogether new policy inasmuch as the respondents had completely given up the method of making selection through dealer Selection Boards. Now, the companies themselves have been authorised to make such selection at their own level. He has brought to the notice of the court a copy of the office memorandum dated 9.5.2002 issued by the aforesaid Ministry.

In the changed circumstances, it would now not be appropriate to continue the petition while at the same time the petitioner, if he feels aggrieved, by the new policy and guidelines provided therein, would be at liberty to file a fresh petition.

With these observations, this writ petition is disposed of.
