KRISHAN KUMAR & ORS. v STATE & ANR. - CRLMP Case No. 539 of 2007 [2007] RD-RJ 2031 (17 April 2007)

S.B.CRIMINAL MISC. PETITION NO.539/2007

(Krishan Kumar & Ors. Vs. State of Raj.)

Date of order : : 17.04.2007

HON'BLE MR. KRISHAN KUMAR ACHARYA, J.

Mr.Vinod Kumar Sharma, for the petitioners.

Heard learned counsel for the petitioners.

Previously, the petitioners filed S.B.Criminal Misc.

Petition No.1620/2006 seeking direction to quash the FIR

No.193/2006, which was dismissed by this Court vide order dated 22.1.2007. Now, again the petitioners have filed this misc.petition under Section 482 Cr.P.C. for quashing of the same FIR. It is stated that petitioners have returned the articles to the father of the complainant Smt.Jyoti during the investigation. The all other grounds raised in this misc. petition have already been raised in previous misc. petition.

At this stage, I do not want to express any opinion on the merit of the case but having considered all the facts and circumstances of the case, I do not find any ground to quash the impugned FIR.

Accordingly, the present misc. petition is dismissed in limine.

(KRISHAN KUMAR ACHARYA), J.
