LRS OF ESA v LRS OF ISHMAIL - CSA Case No. 95 of 2004 RD-RJ 2075 (18 April 2007)
S.B.Civil Second Appeal No.95/2004.
LRs. of Esa and others. vs.
LRs. of Ismile.
Date : 18.4.2007
HON'BLE MR. PRAKASH TATIA, J.
Mr.R Bhansali, for the appellants.
Mr.RR Nagori, for the respondent.
Heard learned counsel for the parties.
The appellants are aggrieved against the concurrent finding of fact recorded by the two courts below wherein the two courts below held that the plaintiff is owner of the plot in dispute and the defendants failed to prove that the said plot was joint property and came in the defendants' share. The finding of fact has not been vitiated by any reason.
In view of the above, I do not find any substantial question of law involved in this appeal.
Consequently, this second appeal, having no merit, is hereby dismissed.
(PRAKASH TATIA), J.
