Heard learned counsel for the applicant as well as the learned
By way of filing present misc. fourth bail application under
Section 439 Cr.P.C., it is contended by learned counsel for the applicant that serious injuries were received by him also and a cross case arising out from the same incident was registered against the complainant party. The bail application of the applicant was rejected on the ground that still in cross case charges have not been framed so far.
It is contended by learned counsel for the applicant that after filing this application though charges have been framed but trial court is not deciding this matter whereas all the prosecution witnesses have been examined and statement under Section 313 Cr.P.C. have also been recorded and statements of defence witnesses were also recorded by the trial court.
Looking to the facts and circumstances of the case and in the
Sardara vs. State of Rajasthan interest of justice the learned trial court is directed to expedite and conclude the trial of cross case filed against the complainant which is pending while conducting the proceedings of trial day to day.
