Learned counsel for the petitioner wants to withdraw this misc. petition. However, he prays that petitioner may be given liberty to file appeal against the order dated 15.6.2005.
Accordingly, this misc. petition is dismissed as withdrawn. However, petitioner is at liberty to avail alternative remedy provided under the law. As far as limitation of appeal is concerned, it may be decided objectively by the learned appellate court after considering all the facts and circumstances of the case in accordance with the law.
