This misc. petition under Section 482 Cr.P.C. has been filed by the petitioner seeking direction to expedite investigation in FIR No.85/2002, Police Station Bagara, District
Jalore for offence under Sections 323, 427, 506 IPC and Section 3
(v)(x) of SC/ST (Prevention of Atrocities) Act.
Learned Public Prosecutor states that police after investigation has already filed FR in this case, therefore, this misc. petition has become infructuous. Learned counsel for the petitioner states that protest petition filed before the trial court is still pending. He prays that trial court may be directed to decide the protest petition as early as possible.
I have perused the relevant record produced by learned counsel for the parties. It appears that that FR was given in the year 2005 but the protest petition has not yet been decided. It is expected from the trial court to decide the protest petition expeditiously. The misc. petition is disposed of, accordingly.
