Mr.Manish Pitaliya, for the petitioner.
Heard learned counsel for the petitioner.
The only prayer made by the learned counsel for the petitioner is that instead of warrant of arrest, bailable warrant be issued against the petitioner. Since, the petitioner is not appearing before the court concerned since 2004, therefore, no such request can be allowed. However, looking to all the facts and circumstances of the case, it is ordered that petitioner if so wishes may surrender before the Additional Sessions Judge of the area concerned who shall decide the bail application of the petitioner in accordance with the law on the same day.
With the aforesaid observation/directions, this misc. petition stands disposed of.
