Heard learned counsel for the parties.

By way of this petition, the petitioner is seeking permission to appear in due papers of M.B.A.

Part-II Examination. The petitioner cleared all papers except one of M.B.A. Part-II and in that too, he is not being allowed to appear and has not been given the 5th chance because he has already availed of 4th chance, which is the maximum permissible limit.

Shri R.A. Katta learned counsel appearing for the University of Rajasthan however submits that only four chances are available to a student under the rules and if the petitioner has not been able to clear the due papers of M.B.A. Part-II Examination under the M.B.A. (Old Scheme) Examination, 2006 inspite of his availing 4th chance, 5th chance cannot e allowed to him.

In the facts of the case and keeping in view he fact that if petitioner is not allowed the 5th hance in one remaining paper only, all efforts put n by him for clearing remaining papers would go aste. In this situation, I deem it just and proper o direct the petitioner to make a representation to the Vice Chancellor of the University of Rajasthan,

Jaipur and on representation being filed, the Vice

Chancellor of the University in exercise of his discretionary powers may consider such a request keeping in view the hardship of this peculiar case and pass an appropriate order within a month of making such representation.

The writ petition is accordingly disposed of.
