Date of Order : 11/5/2007.
CORUM
HON'BLE MR.JUSTICE MOHAMMAD RAFIQ
Shri Rajeev Sogarwal for the petitioners.
******
Heard learned counsel for the petitioners.
Grievance of the petitioners is that respondents are proceeding to execute the work of catchment of the land of Villages Amarpura and
Kanwarpura of District Bundi without giving any notice and against the proposal of the Gram
Panchayat.
In the facts of the case, instead of directly entertaining this petition, I deem it appropriate to direct the petitioners to make a representation detailing out their grievances which they have raised in this writ petition before the Divisional
Commissioner Kota Rajasthan who shall examine the matter and decide the representation by a reasoned order appreciating the facts narrated by the petitioners and also the argument as to compliance of the provisions of Section 23 of the Land
Development Corporation Act, 1975. The representation shall be decided as expeditiously as possible but in no case later than six weeks from the date the representation is submitted before it.
The petitioners shall also be free to make request for the interim-relief to the Divisional
Commissioner, respondent No.2.
With these observations, the writ petition is disposed of.
