The present criminal revision petition under
Section 397 r/w Section 401 Cr.P.C. is preferred by the accused-petitioner against the order dated 09.10.2000 passed by the Additional Sessions Judge, Gangapur City in Criminal Revision No. 18/99 as also against the order dated 15.11.2000 passed by the Civil Judge (Jr.
Division) & Judicial Magistrate, Bamanwas in Criminal
Case No. 202/2000, whereby cognizance for the offence under Section 500 IPC has been taken against the accused-petitioner.
Learned counsel for the accused-petitioner placed reliance on the judgment rendered by this Court in S.B. Criminal Revision Petition No. 293/2003-
Ramswaroop & Ors. Vs. State of Rajasthan & Anr., dated 22.02.2007.
Having heard learned counsel for the accused- petitioner and after going through the impugned order, in the interest of justice, I deem it proper to quash and set-aside the impugned order dated 09.10.2000 passed by the Revisional Court i.e. Additional Sessions
Judge, Gangapur City and the order dated 15.11.2000 passed by the Civil Judge (Jr. Division) & Judicial
Magistrate, Bamanwas and remand the matter back to the
Revisional Court for fresh adjudication after giving opportunity of being heard to the accused-petitioner and in the light of judgment rendered by this Court in the aforementioned case of Ramswaroop & Ors. (supra) and shall pass fresh order in accordance with the provisions of law.
With these observation, the revision petition stands disposed of.
Record be sent back forthwith.
