SAMPAT RAJ TAK v SMT.SUMAN TAK - CR Case No. 134 of 2007 RD-RJ 2760 (17 May 2007)
S.B.Civil Revision Pet.No.134/07
Sampat Raj Tak vs. Smt. Suman Tak
Date of Order : 17.5.2007
HON'BLE MR. PRAKASH TATIA,J.
Mr. Anuj Kala for the petitioner
Heard learned counsel for the petitioner.
The petitioner's evidence was closed by the order of the trial court dated 16.5.2007. It is not in dispute that the High Court already directed to decide the matter expeditiously because it was in relation to the custody of children. On 16.5.2007, an application was submitted by the non-applicant requesting for summoning of eight witnesses. That application was dismissed by the trial court.
There is no jurisdiction arising in the impugned order and if the petitioner wants to challenge the said order, he may challenge the order after the decision of the matter by the court below, if any occasion arises for the petitioner to challenge the order dated 16.5.2007 in appeal.
The revision petition is, therefore, dismissed.
