Instant petitions have been filed by petitioner, who was Ex-Sarpanch of Gram Panchayat
Bhadhadar, Panchayat Samiti Dhod, District Sikar, against the order Ann.7 10th February, 2004 of
Divisional Commissioner whereby petitioner was declared to be disqualified after holding inquiry under Rules.
Her only grievance is that recovery which has been ordered under the order impugned is not legally sustainable.
From perusal of order Ann.7, finding has been recorded after explanation was called for from petitioner. The authority was not satisfied and after taking holding inquiry finally opined that a sum of Rs.41363/- is required to be recovered from her and as a consequence thereof being held guilty for the irregularities committed, she was
CW 894/04 disqualified as well. Disqualification recorded under order impugned has not been questioned.
I have gone through the order impugned dated 10th February, 2004 in which details have been furnished on account of which recovery has been ordered by the competent authority and the same is duly supported by material on record and this court is of the opinion that the amount which was sought to be recovered from petitioner does not call for interference by this court under the order impugned.
Consequently, the writ petitions fail and are hereby dismissed. [AJAY RASTOGI],J.
