Heard learned counsel for the petitioner.
The petitioner has challenged the order dated 12.12.06 whereby it was found that the mining area of the petitioner is lying within the limits of forest department and on that basis the government vide its order dated 14.2.07 has cancelled the lease granted to the petitioner. The petitioner now prays that the respondents should be directed to permit him to remove the crushers existing on the mining area.
In the facts of the case, it is directed that in case no amount is to be recovered from the petitioner and the Forest Department has seized the crushers and other machinery of the petitioner, the same be released to the petitioner. In case the Forest
Department has any reason not to release the crushers or any other equipment of the petitioner, they shall pass reasoned order to that effect and communicate to the petitioner within one month from the date copy of the order is produced before it.
With these directions, the writ petition stands disposed of.
