Heard learned counsel for the petitioner.

By the impugned order, the learned trial court has only restrained the petitioner from selling, gifting and mortgaging the suit property, and that order has been affirmed in appeal. It would suffice to say that, even if this order would not have been there, Section 52 of the

Transfer of Property Act would otherwise have also effected any such act of the petitioner, if done.

In this view of the matter, the order does not require any interference. The writ petition, therefore, is dismissed summarily. However, the learned trial court is directed to expedite the disposal of the suit.
