HON'BLE MR.JUSTICE RAJESH BALIA
HON'BLE MR.JUSTICE BHANWAROO KHAN
Mr.R.S.Choudhary for the applicant
Mr.K.L.Thakur, Additional Advocate General
An application has been moved by one Magna Ram seeking direction to remove the encroachments made by respondents No.3 to 6. In fact directions have been sought to quash the order dated 6.5.1980 and restore the original shape and title of the land bearing Khasra No.85 of village Jhordan.
Suffice it to say that this is a disposed of matter. The applicant is not party to writ petition. Such applications have earlier been dismissed either filed by the applicants who ere not party to the writ petition or those, who claimed that the disturbance of their possession is contrary to the title held by them have been rejected by this Court observing that such applications are not maintainable in a disposed of writ petition and any person aggrieved of such orders can pursue an independent remedy available to them under law.
In the circumstances this application is rejected without prejudice to the rights and contentions before the appropriate forum.
