Heard learned counsel for the petitioner.

This writ petition has been filed challenging the order dated 24.3.2007 whereby the application of the respondent under Order 16 Rule 14 of CPC has been allowed and it has been directed that

Shri Brij Kishore Pareek, Executive

Officer of the Municipal Committee, Niwai be summoned at the instance of the plaintiff.

On perusal of the order and the reasons given therein, I do not find that the learned trial court has committed any such error which may warrant interference by this Court in exercise of its powers of judicial review under Article 226 of the Constitution of India.

The writ petition is accordingly dismissed.
