The present criminal revision petition under
Section 397 r/w Section 401 Cr.P.C. is preferred by the accused-petitioners against the order dated 20.04.2007 passed by the Civil Judge (Jr. Division) & Judicial
Magistrate, Kaman, District Bharatpur, by which the
Court below has summoned the petitioners through warrants of arrest and against the order dated 28.10.2002 passed by the Judicial Magistrate, First
Class, Kaman in Criminal Case No. 451/2002 whereby the
Court below took cognizance against the accused- petitioners for the offence under Sections 376 IPC.
Learned counsel for the petitioners without challenging the impugned order on merits, only prayed that the arrest warrants be converted into bailable warrants.
Having considered the rival submissions of the respective parties and after going through the impugned orders dated 20.04.2007 and 28.10.2002, I find no illegality or error apparent on the face of the record and no interference whatsoever is required by this
Consequently, the revision petition fails and the same is hereby dismissed.
However considering the request made on behalf of the accused-petitioners, in the interest of justice, the arrest warrants issued against the petitioners are converted into bailable warrants.
