HARI RAM v PADAMA RAM & ORS. - CRLBC Case No. 12 of 2007 RD-RJ 3095 (2 July 2007)
S.B.Cr. Misc. Bail Cancellation Appl. No.12/2007
(Hari Ram vs. Padma Ram & Ors.)
Date of order : July 02, 2007
Mr.D.L.R.Vyas, for the petitioner.
Mr.Ashok Upadhyaya, P.P.
Mr.Kishore Ranga, for accused-respondents No.1 to 3.
Heard learned counsel for the parties.
Learned counsel for the petitioner submits that the police after investigation has filed the challan and the accused- respondents have been enlarged on bail by the trial court under section 437 Cr.P.C.
By the instant application, the petitioner-complainant seeks cancellation of the anticipatory bail granted to the accused- respondents. Since the accused-respondents have already appeared before the trial court and were taken into custody and thereafter released on bail, the application seeking cancellation of anticipatory bail has become infructuous.
The application seeking cancellation of anticipatory bail is, therefore, dismissed as having become infructuous.
