Heard learned counsel for the applicant as well as learned Public Prosecutor for the State.
The allegation against accused is under
Section 302 IPC. The order of the learned Lower Court for rejection of bail application under Sec. 439
Cr.P.C. reveals that there was a pending enquiry about the mental status of the accused under Section 328
Cr.P.C., but the same has been withdrawn and now only they are pressing application under Sec. 439 Cr.P.C.
As per record it is the accused, who is responsible for all the injuries given by him to the deceased.
At this juncture, it is not a fit case to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 439 Cr.P.C. is rejected.
