Learned counsel for the petitioner submits that he does not want to press the bail application filed under Sec.439 Cr.P.C. at this stage.
Accordingly, bail application filed under
Sec. 439 Cr.P.C on behalf of petitioner-applicant is hereby dismissed as not pressed with liberty to the petitioner to file afresh as and when the statement of medical jurist is recorded before the trial court. The trial court is directed to record the statement of medical jurist after framing the charges as early as possible preferably as first witness.
