A suit was filed by plaintiff-respondent for cancellation of registered sale deed dated 21st
May, 1973 and so also for possession.
Learned trial Judge after taking into consideration the material decreed the suit in favour of non-petitioner vide judgment & decree dated 15th December, 1992 and appeal preferred by defendant-appellant was dismissed vide judgment dated 5th February, 2007.
The question which petitioner-appellant raised, in my considered opinion, is a question of fact and both the courts below recorded a concurrent finding which cannot be appreciated in the instant appeal. No substantial question of law arises for consideration.
Consequently, the instant appeal fails and is hereby dismissed. [AJAY RASTOGI],J.
