Mr.Pradeep Shah, for the petitioners.

Mr.Ashok Upadhyaya, P.P. for the State.

Heard learned counsel for the petitioners and the Public

Prosecutor for the State. Perused the order impugned and the police investigation diary.

Learned counsel for the petitioner submits that there is no case against the present petitioner.

Learned Public Prosecutor opposes the bail and submits that there is a direct evidence of criminal conspiracy hatched by the petitioner along with co-accused in a hotel prior to the murder of

Harjeet Singh.

In this view of the matter, in my view, it is not a fit case for grant of anticipatory bail to the petitioner.

The bail application filed by the petitioner under section 438

Cr.P.C. is dismissed.
