The petitioner was enrolled as Sepoy in the
Indian Army on 13.05.1963 in the Jat Regiment and his services were terminated on 25.09.1972 on the ground of physical disability. This writ petition has been filed by the petitioner after issuing notice to the respondents to seek direction to constitute a medical board for examination of the petitioner to assess his entitlement for disability pension.
Having considered the submissions made on behalf of the petitioner, as the petitioner has represented before the respondents and also served a notice for demand of justice, it is for the respondents to consider the same and if law permits to hold a medical board to examine the petitioner for assessing his entitlement for disability pension, the respondents may consider the case of the petitioner and in case he is not entitled to get any relief, appropriate order be passed by the respondents on the representation and the petitioner be informed accordingly.
With these observations, the writ petition stands disposed of.
