SMT JIGYASA NAGAR v STATE OF RAJ AND ORS - CW Case No. 4669 of 2007 RD-RJ 3247 (9 July 2007)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
AT JAIPUR BENCH, JAIPUR
S.B. CIVIL WRIT PETITION NO. 4669/2007
SMT. JIGYASA NAGAR Vs. STATE OF RAJ. & ORS.
HON'BLE MR. K.S. RATHORE, J.
Mr. Ashwani Chobisa for the petitioner.
The short controversy involved in this writ petition is that the petitioner was not considered as the bonafide resident of Bundi District though she was having a certificate of bonafide resident of Bundi and the same was produced before the respondents but it has not been considered.
The petitioner only claimed that she may be considered and if she is bonafide resident of Bundi
District, she may be considered in the list prepared for the Bundi District for the purpose of giving appointment on the post of General Nursing Midwife.
It is also contended that the less meritorious than the petitioner has been considered but the petitioner has wrongly been not considered.
In view of the request made on behalf of the petitioner, I deem it proper to direct the respondents to consider the case of the petitioner and in case the petitioner is bonafide resident of Bundi District and to this effect certificate is issued by the competent authority, she may be considered in the list prepared for Bundi District. Accordingly the merit list be prepared and if the petitioner is found eligible, she may be considered for the post of General Nursing
With the aforesaid observations, the writ petition stands disposed of.
