We heard counsel for the appellant and perused the order of Board of Revenue dated 14/1/1999. 2. The Board of Revenue on the basis of the material on record and in the light of agreement for sale concluded that Chandan Das and Madan Lal (respondents No.4 and 5) were in cultivatory possession of the subject land. As a matter of fact, we are informed that suit for specific performance of the agreement for sale has been decreed by the civil court in favour of respondents No.3 and 4 and the first appeal is pending wherein some interim-orders have been passed. 3. Be that as it may, the order of the

Board of Revenue did not call for any

DBCSA(W) NO.1382/2006. {3} interference by the Single Judge, dismissal of writ petition by the Single Judge, therefore, cannot be faulted. 4. The special appeal is dismissed in limine.
