Learned counsel for the petitioner submits that he does not want to press the bail application filed under Sec.439 Cr.P.C.
Accordingly, bail application filed under
Sec. 439 Cr.P.C on behalf of petitioner- Abdul Hameed is hereby dismissed as not pressed with liberty to file afresh after recording the statement of the complainant before the trial court. The trial court is directed to record the statement of the complainant as early as possible preferably as first witness.
