Heard learned counsel for the appellant and perused the judgment dated 15.5.2007 passed by the learned Additional
Chief Judicial Magistrate (S.D.) Pali, acquitting accused- respondent No.2 Mukesh Choudhary. I am satisfied that it is a fit case for grant of Leave to Appeal. Accordingly, Leave to
Appeal is granted. The memo of leave to appeal be treated as memo of appeal. Learned Public Prosecutor Mr. V.R.Mehta is appearing on behalf of the State.
Let the presence of accused respondent No.2 Mukesh
Choudhary be secured by issuing bailable warrant in the sum of
Rs.10,000/- for his appearance on the date fixed, returnable within a period of three months and any other subsequent date as and when called upon to do so. If the accused respondent is served and he put his appearance through the lawyer then he will not require to appear personally.
