Learned counsel for the petitioner submits that the controversy involved in the present case has already been decided by a co-ordinate Bench of this
Court in S.B. Civil Writ Petition No. 7199/2002- Pokhar
Ram Vs. The State of Rajasthan & Ors., vide order dated 21.05.2007.
Accordingly, in the light of the judgment rendered by this Court in the aforementioned case of
Pokhar Ram (supra), the present writ petition is partly allowed. The condition imposed by the respondents in order dated 22.07.2002 regarding semi permanent and permanent status is quashed. However, regularisation will be governed by the Rules as well as the Scheme framed by the Government in the light of the judgment of the Hon'ble Supreme Court in the case of Secretary,
State of Karnataka and others Vs. Uma Devi (3), reported in 2006(4) SCC 1.
