Learned counsel for the petitioner-Revenue submits that this revision petition arises out of the provisional assessment order.
Learned counsel further submits that final assessment order has since been passed, therefore, this revision petition arising out of the provisional assessment order has become infructuous. Learned counsel has relied upon a recent judgment of this court in Asstt.
Commissioner, Commercial Taxes, Pali Vs. M/s. Mahaveer Timber
Mart, Ahore, reported in 18 Tax Update page 45, to this effect.
In view of the aforesaid position, this revision petitions is dismissed as infructuous.
