IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR
--------------------------------------------------------
CIVIL REVISION No. 180 of 2005
VELJI & ORS
V/S
LRS OF LALU
Mr. MAHENDRA TRIVEDI, for the appellant / petitioner
Mr. NK RASTOGI, for the respondent
Date of Order : 23.7.2007
HON'BLE SHRI N P GUPTA,J.
ORDER
-----
This revision has been filed against the impugned order dismissing the appeal as abated being dt. 18.2.2005.
In view of the judgment of Hon'ble the Supreme Court in
Ajay Bansal Vs. Anup Mehta reported in JT 2007(2) SC-239, no revision could lay against such an order, and only second appeal could be filed. Obviously, therefore, this revision could be, and was required to be dismissed when it came up for consideration on 5.7.2007, however, extending indulgence one week's time was granted to the learned counsel to take appropriate steps for converting revision into second appeal. However, no steps have been taken within the time granted. As such the revision petition is dismissed.
