This writ petition is directed against the order dated 03.09.2005 (Annexure-5) passed on the stay application by the Rajasthan Non-Government Educational

Institutions Tribunal, Jaipur (for short 'the

Tribunal'), by which stay order was granted by the

Tribunal in favour of respondent No.1 Smt. Uma Devi

Sharma..

At the time of issuance of notice, this Court vide order stayed 19.09.2005, stayed the operation of the order dated 03.09.2005 (Annexure-5).

Learned counsel appearing for the respondent

No.1 Smt. Uma Devi, submits that since appeal is pending before the Tribunal, therefore, till the decision of the appeal, the order passed by this Court may remain in force subject to decision of the appeal, which has not been opposed by the learned counsel appearing for the petitioners.

Having considered the request made on behalf of the respective parties, the Rajasthan Non-Government

Educational Institutions Tribunal, Jaipur is directed to decide the appeal expeditiously and till then, the interim order dated 19.09.2005 granted by this Court shall remain in force and immediately after passing of order on the appeal by the Tribunal, this interim order shall stand vacated automatically.

With these observations, the writ petition stands disposed of.
