Heard learned counsel for the petitioner.
In the considered view of this Court, the present writ petition is premature as it is not directed against any impugned order and submitted on the ground that the petitioner filed an application under Order 39 Rule 7 r/w Section 151 CPC. The defendant petitioner has filed this writ petition as the plaintiff refused to submit reply and the arguments were heard on 16.07.2007. It is alleged that after hearing arguments, the trial Court has not passed any order.
I failed to understand that without making any request to the trial Court, the petitioner has directly filed this writ petition before this Court. Therefore, the present writ petition, being misconceived, deserves to be dismissed.
It is of course expected from the trial Court to pass an order on the application expeditiously, if the arguments are heard finally, but to this effect, this Court do not want to issue any writ, order or direction.
Consequently, the writ petition stands dismissed.
