The present revision petition under Section 397 r/w Section 401 Cr.P.C. is directed against the judgment dated 07.05.2004 passed by the Special Judge,
SC/ST (Prevention of Atrocities) Cases, Dausa in
Criminal Case No. 40/2003, whereby the accused- respondents have been acquitted from the offences under
Sections 341, 323 IPC and Section 3(1)(x) of the SC/ST
(Prevention of Atrocities) Act, 1989.
Having heard learned counsel for the complainant-petitioner, learned Public Prosecutor for the State and upon careful perusal the impugned judgment dated 07.05.2004, it appears that the incident took place outside the bank and the eye-witnesses whose names were furnished by the complainant have not corroborated the incident. Since during investigation /2/ the incident and the allegations found false, the police submitted final report and the complainant is also not able to establish his case before the Court below, therefore, the accused-respondents have rightly been acquitted from the offences under Sections 341, 323 IPC and Section 3(1)(x) of the SC/ST (Prevention of
Atrocities) Act, 1989 vide impugned judgment dated 07.05.2004. I find no illegality in the impugned judgment and the same requires no interference whatsoever by this Court.
Consequently, the revision petition fails and the same is hereby dismissed.
