IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR
--------------------------------------------------------
CIVIL REVISION No. 136 of 2007
M/S BANKE BEHARI PROCESSORS
V/S
SUSHIL TOSHNIWAL
Mr. SANJEET PUROHIT for Mr. VINOD PUROHIT, for the appellant / petitioner
Mr. JITENDRA GANG, for the respondent
Date of Order : 3.8.2007
HON'BLE SHRI N P GUPTA,J.
ORDER
-----
Heard learned counsel for the parties.
Perused the impugned order.
Admittedly, the application said to have been filed under Section 6 before the Debt Relief Court is not shown to have been admitted. Then, so far as the application decided by the impugned order is concerned firstly that is not supported by any affidavit, nor is it in prescribed proforma prescribed under the Rules for filing application under Section 5 of the Rajasthan Relief of Agricultural Indebtedness Act, 1957.
In that view of the matter, I do not find any error in the impugned order, so as to require any interference in my revisional jurisdiction.
The revision petition is, therefore, dismissed summarily.
