Instant petition has been filed by accused- petitioner assailing the FIR which was lodged on 9th February, 2001.
A complaint was lodged by Shri Dalchand in which it was alleged that few persons came and after pouring kerosene oil over Jeep & Tractor put them on fire on account of which he has been put to loss of more than Rs.2 lacs. On his said report, FIR was registered u/s.435 IPC.
It has been brought to the notice of this court that after investigation, statements were recorded u/s.161 Cr.P.C. The accused-petitioner has been specifically named certainly it is at the stage of investigation. Petitioner will be at liberty to raise objections at the stage of framing charges. No case for interference is made out. Accordingly, the misc. petition stands dismissed. [AJAY RASTOGI],J.
