This appeal by the owner of the vehicle, involved in the accident held liable to make payment of the amount of compensation suffers from the fundamental defect that the appellant has not produced the proof of depositing the amount as required by Section 173 of Motor Vehicles Act.

Defect has not been cured though the appeal was filed as back as on 07.06.2006.

Learned counsel for the appellant submits that despite intimation, the appellant has not extended any further instructions.

For being fundamentally incompetent, the appeal cannot be proceeded further and is, therefore, dismissed as such.
